CBD Laws by State
[social_warfare]CBD is becoming increasingly popular across the United States as a legal alternative to cannabis.
Many CBD products these days are made using hemp extracts, making them federally legal in the United States according to the 2018 Farm Bill.
What’s more, cannabis-based CBD products are legal in states where marijuana is legal for medical or recreational use. In these states, users also have access to products containing both THC and CBD, giving you the benefits of both cannabinoids.
With that said, CBD laws can differ from state-to-state. While hemp products are federally legal, some states have restrictions on selling CBD. States also differ in whether they also offer cannabis-based CBD products.
Here’s a breakdown of CBD laws by state to help:
Alabama
- Medical Cannabis: Legal (limited to CBD Oil)

Marijuana is still illegal in Alabama for both medical and recreational purposes. However, in accordance with Carly’s Law (2014) and Leni’s Law (2016), patients suffering from debilitating seizures are able to use CBD Oil provided it contains less than 0.3% THC. Parents of children suffering from seizures are also able to obtain CBD Oil for their children.
Hemp-based CBD products are fully legal in Alabama, which means that anyone is able to buy products such as CBD Oils, Topicals, and Vape Products provided that they’re extracted from hemp and contain less than 0.3% THC. An upcoming bill may soon also make medical marijuana legal in Alabama.
Alaska

Cannabis products are legal in Alaska, both for medical use and recreational use. Adults aged 21 or over can easily buy cannabis-derived CBD products from local stores, and those with medical cards can also buy cannabis-derived CBD products from dispensaries.
If you’re under 21 and don’t have a medical card, you can still use hemp-based CBD products that contain less than 0.3% THC. The state currently doesn’t have an industrial hemp program and CBD products in the state are unregulated. However, Senator McConnell states that laws against CBD aren’t being enforced and CBD buyers should beware of low-quality products.
Arizona

Medical marijuana became legal in Arizona in 2010. However, the laws are murky when it comes to cannabis-based CBD products and some users have faced charges over buying CBD Oil extracted from marijuana plants.
In accordance with the 2018 Farm Bill, hemp-based CBD products with less than 0.3% THC are legal in Arizona. Arizona law enforcement agencies have confirmed that users can legally buy these products.
Arkansas

Medical marijuana became legal in Arkansas in 2016 with the Arkansas Medical Marijuana Amendment. Patients with a medical card are able to buy medical marijuana and cannabis-derived CBD products from dispensaries.
Regular users can also buy all kinds of hemp-derived CBD products containing less than 0.3% THC. The state of Arkansas has an industrial hemp pilot program allowing for the legal production, sale, and purchase of hemp products.
California

All kinds of marijuana products are legal for adults in California. Those aged 21 or over are able to buy various cannabis products, including CBD products, for either recreational or medical use from a range of stores and dispensaries across the state.
Hemp-based CBD products containing less than 0.3% THC are also available across the state. However, there is one important restriction. According to the California Department of Health, foods infused with CBD are prohibited until they’re approved by the FDA.
Colorado

Colorado was the first state to legalize marijuana for adult use and the marijuana market in The Centennial State is still thriving. Adults aged 21 or over can buy cannabis and CBD products from a range of stores and dispensaries.
Alternatively, users can also buy hemp-derived CBD products across Colorado. Colorado has an industrial hemp pilot program and legislation that separates the legal definitions of marijuana and hemp.
Connecticut

The recreational use of marijuana is still illegal in Connecticut, although the possession of small amounts is decriminalized and there are efforts to legalize recreational marijuana this year.
The Connecticut medical marijuana program allows certain patients to access medical marijuana and cannabis-derived CBD products.
Hemp-based CBD products containing 0.3% THC or less are also legal for everyone in Connecticut. The state passed HB 5780 in 2015- an act that legalized industrial hemp.
Delaware

Delaware is another state where marijuana products are only legal for medical use. The Delaware Medical Marijuana Act (2011) allows certain patients and caregivers to obtain a medical card to access medical marijuana.
Changes made to the Medical Marijuana Act in 2015 allow patients with certain conditions to obtain CBD Oils derived from marijuana containing less than 7% including minors. These changes were made under Rylie’s Law.
Hemp-derived CBD products containing 0.3% THC or less are legal for everyone in Delaware and the state also has an industrial hemp pilot program.
Florida

While recreational use of marijuana is still illegal in Florida, the state legalized medical marijuana in 2016 and has a successful medical marijuana program. Patients with certain conditions can get a medical card to buy marijuana products from Florida dispensaries.
Marijuana-derived CBD products can be accessed by medical patients. The state also has a statute that defines low-THC cannabis products as having less than 0.8% THC and over 10% CBD. Physicians can prescribe these to patients for certain conditions.
Hemp-based CBD products are legal across the state for all purposes. Users can purchase these in stores and the state has an industrial hemp pilot program.
Georgia

Georgia allows certain patients with certain conditions to use marijuana-derived CBD products under Haleigh’s Hope Act (2015). These products must contain less than 5% THC and levels of CBD equal to or greater than the THC.
Recreational use of marijuana is still illegal in Georgia, although personal use and possession have been decriminalized.
All users in Georgia can use hemp-derived CBD products that contain less than 0.3% THC. These products are widely available and you don’t need medical approval to use them.
Hawaii

Hawaii has a successful medical marijuana program that allows users with medical cards to buy marijuana and marijuana-derived CBD products from a range of dispensaries. Interestingly, Hawaii also allows out-of-state visitors to buy medical marijuana if they have medical approval.
Recreational use of marijuana is still illegal in Hawaii, although the state has decriminalized the possession of small amounts.
The state also has an industrial hemp pilot program, allowing for the production and sale of hemp products, including hemp-derived CBD products. All users are able to use hemp-derived CBD products without a medical card.
Idaho

Idaho has some of the strictest laws in the country when it comes to cannabis products. Marijuana is illegal both for recreational and medical use, and possession comes with strict punishments.
Although hemp-derived CBD products are federally legal, Idaho still imposes restrictions on these products. According to Idaho Code, legal cannabidiol products must be completely THC-free and only be extracted from certain parts of cannabis plants.
Patients with severe forms of epilepsy can be prescribed Epidiolex- an FDA-approved drug containing CBD.
Illinois

Medical cannabis became legal in Illinois in 2013. Recreational use of cannabis became legal via a bill signed into law in June 2019, and the law came into effect on January 1st, 2020. Users aged 21 or over are now able to buy marijuana and cannabis-derived CBD products from stores across the state.
Hemp-based CBD products containing 0.3% THC or less are also available to all users in Illinois. The state has an industrial hemp pilot program and even passed a bill specifically allowing low-THC hemp extracts.
Indiana

Indiana still has strict laws against the use of marijuana products. Marijuana is illegal both for recreational and medical purposes, although users across the state can still buy hemp-derived CBD products.
Hemp-based products are legal and you can find these in many stores. Indiana also passed Senate Bill 52 to allow low-THC hemp extracts and forbid the sale of marijuana-based high-THC CBD products.
Iowa

Marijuana is still illegal in Iowa both for recreational and medical use. However, the state does have a medical CBD program that allows patients with certain severe conditions to access CBD Oil and other such products.
In accordance with the 2018 Farm Bill, users can also buy hemp-derived CBD products containing 0.3% THC or less. The state currently does not have an industrial hemp program.
Kansas

Kansas doesn’t allow the recreational use of marijuana and does not have a medical marijuana program. However, the state passed a bill in 2018 which removed THC-free hemp products (including CBD products) from the controlled substances list.
While you can’t access marijuana-based products, users should have no problem getting hemp-derived CBD products. In 2018, Kansas also launched an industrial hemp pilot program allowing for the production and sale of hemp products.
Kentucky

Marijuana is still illegal in Kentucky and the state does not have a medical marijuana program. However, the state passed a unique bill in 2014 that exempts CBD Oil from being defined as a marijuana product and allows it to be administered to patients with seizures.
The bill is named The Clara Madeline Gilliam Act after the Hopkins County child whose parents lobbied for the bill to be legalized.
While high-THC CBD products are still illegal for regular users, users can buy hemp-derived CBD products containing 0.3% THC or less. The state also began its industrial hemp pilot program in 2016.
Louisiana

Louisiana legalized medical marijuana in 2017, allowing patients with certain conditions to obtain a prescription for medical marijuana and CBD products. Recreational use of marijuana is still illegal in Louisiana.
The state has no laws regarding CBD and no industrial hemp pilot program. However, in accordance with the 2018 Farm Bill, users should have no problem buying and using CBD products provided that they use hemp extracts and contain 0.3% THC or less.
Maine

Maine has a long-running medical marijuana program. Medical marijuana has been legal in the state since 1999 and passed an official medical marijuana law in 2009. Patients with debilitating conditions can access medical marijuana and CBD products from Maine dispensaries.
Recreational marijuana use became legal in Maine in 2016, allowing adult users to buy marijuana products.
Maine also legalized the commercial production of hemp in 2015. As such, all kinds of CBD products are legal in Maine and all users can easily access hemp-derived CBD products.
Maryland

Maryland has a medical marijuana program regulated by the Maryland Medical Cannabis Commission. Patients with certain conditions are able to access marijuana and cannabis-infused products, including CBD products.
Recreational marijuana use is still illegal in the state, although Maryland has decriminalized the possession of small amounts.
Much like the majority of states, you’re able to buy and use hemp-derived CBD products containing less than 0.3% THC regardless of your age or medical status. Maryland has an industrial hemp pilot program and separates the legal definitions of marijuana and hemp.
Massachusetts

All forms of CBD are legal in Massachusetts. The state legalized medical marijuana in 2012, allowing patients with debilitating conditions to access medical marijuana and cannabis-derived CBD products.
Recreational use was legalized in Massachusetts in 2016, meaning adults aged 21 or over can also buy cannabis and cannabis-infused products in legal stores.
Of course, hemp-derived CBD products are also available to users regardless of age or medical status. The state launched its industrial hemp pilot program in 2017.
Michigan

Michigan has legalized marijuana for medical and recreational use. Medical marijuana was legalized in the state in 2008 whereas recreational use was legalized in 2018.
The recreational market came into effect in late 2019. Since then, the Michigan marijuana market is thriving and users are able to access a range of marijuana products as well as cannabis-derived CBD products.
Hemp-derived CBD products are also available in various stores, even to those who aren’t able to buy marijuana. The state launched its industrial hemp pilot program in 2016.
Minnesota

While recreational marijuana is still illegal in Minnesota, the state has a medical marijuana program that allows patients with various qualifying conditions to access marijuana and marijuana-infused products, including CBD.

Mississippi

Medical marijuana is still illegal in Mississippi. However, under Harper Grace’s Law, the state allows patients with severe epilepsy to be prescribed CBD products for their symptoms. These products must contain 0.5% THC or less and over 15% CBD.
Recreational marijuana is also illegal in Mississippi, although the possession of small amounts has been decriminalized.
In accordance with the 2018 Farm Bill, users can use hemp-derived CBD products containing 0.3% THC or less. The state currently does not have an industrial hemp pilot program.
Missouri

In 2014, Missouri passed a bill allowing qualifying patients to use medical CBD products containing less than 0.3% THC and at least 5% CBD.
Since 2018, the medical cannabis program has been expanded to allow patients with various qualifying conditions to access medical marijuana. Recreational use of marijuana is still illegal.
You can also use hemp-derived CBD products provided that they contain 0.3% THC or less and Missouri has an industrial hemp pilot program.
Montana

Recreational marijuana is still illegal in Montana. However, the state has a medical marijuana program that has been running ever since 2004. Patients with qualifying conditions can get a medical card and access medical cannabis and CBD products from Montana dispensaries.
Hemp-derived CBD products are also legal provided that they contain 0.3% THC or less. These are available to all users. Montana has an industrial hemp pilot program allowing for the production and sale of hemp products.
Nebraska

Nebraska has strict laws against the use of marijuana either for medical or recreational use. It also has some of the most complicated and restrictive laws when it comes to using CBD products.
Although the state has an industrial hemp pilot program, the Nebraska Uniform Controlled Substances Act defines CBD as a marijuana product. The state previously allowed patients with intractable epilepsy to use CBD as treatment, but the program expired and the president even released a statement to clarify that CBD is still classified as marijuana.
While hemp-based CBD products are federally legal according to the 2018 Farm Bill, Nebraska’s restrictions make things complicated for residents. Some patients can access CBD-based medications such as Epidiolex.
Nevada

Nevada has some of the least restrictive laws when it comes to marijuana and CBD. Medical marijuana is legal in Nevada, allowing patients with certain qualifying conditions to access medical marijuana and CBD products from state dispensaries.
Recreational use of marijuana is also legal. Users aged 21 or over can access marijuana and CBD products from a range of cannabis stores across the state.
Hemp-derived CBD products with less than 0.3% THC are also widely available to users regardless of age or medical status. Nevada also has an industrial hemp pilot program.
New Hampshire

Anyone can buy and use hemp-based CBD products without medical approval. The state also has an industrial hemp pilot program allowing for the production and sale of hemp products.
New Jersey

While recreational use of cannabis is still illegal in New Jersey, the state launched its Medicinal Marijuana Program in 2009. Patients with qualifying conditions can buy and use marijuana products as well as cannabis-derived CBD products.
The state currently does not have an industrial hemp pilot program, but all users can buy and use hemp-derived CBD products containing 0.3% THC or less in accordance with the 2018 Farm Bill.
New Mexico

New Mexico legalized medical marijuana in 2007, allowing qualifying patients with certain conditions to access marijuana for medical use. This also includes CBD products extracted from marijuana plants. New Mexico was also the first state to list PTSD as a qualifying condition for medical marijuana.
Recreation use of marijuana is still illegal in New Mexico, although there are ongoing efforts to legalize recreational marijuana in 2020.
Anyone in New Mexico can buy and use hemp-derived CBD products containing 0.3% THC or less. These are widely available and the state also has an industrial hemp pilot program allowing the production and sale of hemp products.
New York

Recreational use of marijuana is still illegal in New York, but certain patients can obtain marijuana for medical use. The New York State Medical Marijuana Program allows patients with qualifying conditions to obtain marijuana and cannabis-derived CBD products from state-licensed dispensaries.
Users without medical cards can still use hemp-derived CBD products. These products are legal for everyone without a medical card provided that they’re made with hemp extracts and contain 0.3% THC or less. New York has an industrial hemp pilot program that continues to expand.
North Carolina

Marijuana is illegal in North Carolina for both medical and recreational use. However, the state does have a limited medical program that allows patients with intractable epilepsy to use CBD products for treatment. These products must contain less than 0.9% THC and 5% CBD or more.
Hemp-derived CBD products are also available to all users across the state. These products must contain less than 0.3% THC. North Carolina also has an industrial hemp pilot program allowing for the production and sale of hemp products.
North Dakota

Recreational use of marijuana is still illegal in North Dakota but medical marijuana became legal with the North Dakota Compassionate Care Act. Patients with qualifying conditions can use cannabis products, including cannabis-derived CBD products.
Those without medical cards can still use hemp-derived CBD products containing 0.3% THC or less. These are available across the state and North Dakota has an industrial hemp pilot program.
Ohio

Medical marijuana became legal in Ohio in 2016, although it took some time for the Medical Marijuana Control Program to launch. Ohio’s medical marijuana program allows patients with qualifying conditions to obtain medical marijuana and cannabis-derived CBD products from state dispensaries. Recreational marijuana is still illegal in Ohio.
Previously, Ohio defined CBD products as marijuana, therefore making them illegal in the state. However, this took place before the 2018 Farm Bill. A bill was also signed making the production and sale of hemp products legal in Ohio.
Anyone can now buy CBD products in Ohio provided that they use hemp extracts and contain 0.3% THC or less.
Oklahoma

Prior to 2018, medical CBD products were only available to qualifying patients with severe epilepsy and other debilitating conditions in Oklahoma. However, medical marijuana became legal in Oklahoma in 2018, allowing patients with various qualifying conditions to access medical marijuana and cannabis-derived CBD products.
Hemp-derived CBD products containing less than 0.3% THC are also available to all users. Oklahoma also enacted an industrial hemp pilot program in 2018 allowing for the legal production and sale of hemp products. Recreational marijuana is still illegal in the state.
Oregon

All kinds of marijuana and CBD products are legal in Oregon. Medical marijuana became legal in Oregon in 2007, allowing patients with qualifying conditions to obtain medical marijuana and medical CBD products from state dispensaries.
Oregon was also one of the first states to legalize recreational use of marijuana in 2014. Now, adults aged 21 or over can find marijuana and cannabis-derived CBD products in cannabis stores across the state.
Of course, hemp-derived CBD products are also available to users regardless of their age or medical status. These products contain less than 0.3% THC. Oregon also has an industrial hemp pilot program for the production and sale of hemp products.
Pennsylvania

Pennsylvania legalized medical marijuana in 2016, allowing patients with qualifying conditions to obtain a medical marijuana ID card. Cardholders can buy marijuana products and cannabis-derived CBD products for medical use. Recreational marijuana is still illegal in Pennsylvania.
All users can buy and use hemp-derived CBD products provided that they contain 0.3% THC or less. You can find these in stores across the state and Pennsylvania also has an industrial hemp pilot program.
Rhode Island

Rhode Island legalized medical marijuana in 2007. Patients with certain qualifying conditions can get a medical marijuana card and access marijuana products in dispensaries across the state. Recreational use of marijuana is still illegal in Rhode Island.
Users can also buy and use hemp-derived CBD products regardless of their age or medical status. These products must use hemp extracts and contain 0.3% THC or less. Rhode Island also has an industrial hemp pilot program.
South Carolina

South Carolina still has strict laws against the use of cannabis either for medical or recreational use. However, there are some exceptions. In 2014, South Carolina passed the Medical Cannabis Therapeutic Treatment Act, also known as Julian’s Law.
This law allows users patients with severe forms of epilepsy such as Dravet syndrome and Lennox-Gastaut syndrome to be prescribed CBD products. These products must contain 0.9% THC or less and at least 98% CBD.
All users are able to buy hemp-derived CBD products containing less than 0.3% THC. South Carolina also has an industrial hemp pilot program.
South Dakota

South Dakota has some of the strictest cannabis laws in the country. Recreational marijuana is still illegal and even possessing small amounts can result in incarceration and fines. The state also does not have a medical marijuana program.
There are some exceptions for cannabidiol-based medical products. The state passed a bill in 2017 allowing medical CBD products approved by the FDA to be prescribed to patients. This is currently limited to Epidiolex.
Previously, CBD was removed from the definition of marijuana but classified as a Schedule IV controlled substance. However, while cannabis-based CBD products are still illegal, the state passed an amendment clarifying that hemp-based CBD products with 0.3% THC or less are legal for everyone.
Tennessee

Marijuana is still illegal in Tennessee both for recreational and medical use. However, the state passed a law in 2014 that allows CBD Oil to be prescribed to patients with intractable epilepsy. These CBD Oils must have 0.9% THC or less and patients must obtain a prescription from a licensed state physician.
Hemp-derived CBD products are available to all users, even without a prescription. These products must have less than 0.3% THC. Tennessee removed industrial hemp from the legal definition of marijuana and the state also has an industrial hemp pilot program allowing for the legal production and sale of hemp products.
Texas

Marijuana is still illegal in Texas both for recreational and medical use. However, patients with intractable epilepsy can obtain a prescription for medical CBD products. These products must contain 0.5% THC or less and 10% CBD at least.
All users can buy hemp-derived CBD products. These products must contain 0.3% THC or less and are widely available across the state. Although residents previously had problems with murky CBD laws, a law legalizing hemp production and sales was signed last year.
Utah

Recreational use of marijuana is still illegal in Utah, but medical marijuana became legal in 2018. Patients with qualifying conditions can buy medical marijuana products from state dispensaries. Utah also has various laws pertaining to CBD.
In 2014, Utah passed the Hemp Extract Registration Act, allowing patients with intractable epilepsy to be prescribed medical CBD products. These products must contain at least 15% CBD.
Furthermore, the Utah Hemp and Cannabidiol Act in 2018 defined and legalized various forms of hemp-based CBD products, separating them from marijuana laws. Hemp-derived CBD products are widely legally available across the state to all users, and Utah also has an industrial hemp pilot program.
Vermont

Hemp-derived CBD products are available for all users and Vermont also has an industrial hemp pilot program.
Virginia

Hemp-derived CBD products are also legal in Washington D.C. and available to all users provided that they contain 0.3% THC or less.
West Virginia
